Students for Fair Admissions v, Harvard and Students for Fair Admissions v. University of North Carolina represent the latest challenges to Affirmative Action in American Higher Education. Each case represents a Title VI challenge by Asian American applicants arguing that race-conscious admissions policies at each institution unfairly discriminates against them. This session will address these much-anticipated rulings and their implications for Higher Education admissions policies and efforts to promote greater post-secondary equity and diversity. The question of the need for continuing race-conscious admissions criteria will be contrasted with non-racial alternatives to creating diverse enrollments. The panel will present an overview of the history and legal evolution of affirmative action and the two Students for Fair Admissions rulings, followed by a point-counter-point discussion of the future of race-conscious admission in light of these rulings. The session will be an interactive discussion.
