This panel presentation/discussion critically reviews the case law involving Fourth Amendment violations by school personnel and school resource officers (SROs), as well as other litigation and controversy that has emerged in the past year involving school policing in public schools. The panelists explain related Fourteenth Amendment complaints, novel legal questions, as well as analysis of prevalent judicial reasoning in these cases. Furthermore, the panel will offer data on the relationship between school policing and exclusionary discipline, lost educational opportunity, and other negative impacts to students. The goal is to inform practitioners, professors, and lawyers about: (a) emerging and continuing legal issues related to search and seizure, (b) the public discourse on law enforcement officers in schools, (c) clear policy guidance and in following routine disciplinary procedures, (b) the proper role of the school resource officer (SRO), and (e) recommendations for best practices with regard to searches and seizures.
