Charles Caleb Colton said, “If you have nothing nice to say, say nothing at all.” While probably sound advice, is it a constitutional proscription on speech? The First Amendment prohibits laws abridging the freedom of speech. But no right is unlimited, and rights often find their limits when balanced against other rights. This presentation reviews the balance struck by courts between a citizen’s First Amendment right to free speech and a school’s ownership right to use its property for the property’s intended purpose and conduct its business. Does this balance allow schools to prohibit people from speaking if they have nothing nice to say?
